Terms & Conditions
1. Applicability
1.2 By booking a lesson or course, you accept these Terms and Conditions.
1.1 These General Terms and Conditions apply to all offers, lessons and courses provided by Learndutch.eu and to all agreements with individual students (consumers), unless explicitly agreed otherwise in writing.
1.3 If any provision of these Terms and Conditions is found to be invalid, the remaining provisions will remain in full force. In such a case, the invalid provision will be replaced by a provision that is as close as possible to the original in purpose and effect.
1.4 The language services described in these Terms and Conditions are provided by Maison Kaori, registered with the Dutch Chamber of Commerce (KvK) under number 99600196, with its correspondence address at Postbus 1810, 2130 JE, HOOFDDORP, the Netherlands.
1.5 These Terms and Conditions apply primarily to contracts with individual consumers. In the case of corporate clients (companies or other organisations), these Terms and Conditions apply unless and insofar as different written agreements have been made with the corporate client.
1.6 The services are intended exclusively for adult learners (18 years and older). Learndutch.eu does not offer courses to minors.
2. Services
2.1 Learndutch.eu provides Dutch language lessons for adults, in the form of private lessons (online) and group lessons (online and in-person), as described on the website or in email communication.
2.2 The exact content, level, duration and schedule of the lessons or courses will be agreed with you in advance and/or described in the course information.
2.3 Learndutch.eu will make reasonable efforts to provide the lessons with care and professionalism. However, learning progress and exam results depend partly on your own effort and cannot be guaranteed.
2.4 Learndutch.eu offers in particular:
- Individual online lessons (one-to-one).
- Online group lessons.
- In-person lessons at rented classrooms or similar external locations.
No fully self-study online video courses or stand-alone digital content are offered at this time. Lessons are conducted in Japanese and Dutch, or a combination thereof, depending on your needs and level.
2.5 Lessons are generally sold as a package of a certain number of lessons (lesson package), as described in the offer or course information. Monthly subscriptions or fixed-duration courses are only offered if explicitly stated.
3. Right of withdrawal (cooling-off period)
3.1 Distance contracts with consumers
If you book a course or package of lessons as a consumer via distance communication (for example via the website or email), you may have a legal right to withdraw from the agreement within 14 days after the date of confirmation of your booking, without giving any reason.
3.2 Lessons starting within the 14-day period
If you ask us to start the lessons within the 14-day cooling-off period, you agree that:
- your right of withdrawal ends once the full service has been provided, and
- if you withdraw after the lessons have started but within the 14-day cooling-off period, you will pay a proportionate amount for the lessons already provided and we will refund the fees for the lessons not yet provided.
3.3 Exercising the right of withdrawal
To exercise your right of withdrawal, you must inform us by email within the 14-day period that you wish to withdraw from the agreement. We will confirm receipt of your request by email. Any refund due will be made within 14 days after our confirmation, using the same payment method you used for the original payment.
4. Fees and Payment
4.1 The applicable lesson or course fees are stated on the website or in the email offer you receive. Unless explicitly stated otherwise, all fees are in euros and inclusive of VAT (if applicable in your situation).
4.2 Lesson or course fees must be paid in advance, no later than 24 hours before the start of the first lesson of the relevant package or course, unless we have agreed on a different payment term in writing.
4.3 Payment can be made by bank transfer, iDEAL or another payment method offered on the invoice or on the website. Any bank charges or currency conversion costs are for your own account.
4.4 If payment is not received on time, we have the right to suspend lessons until the full payment has been received. This does not entitle you to a refund or free rescheduling of missed lessons.
4.5 For private lessons and small group courses, you will receive an invoice by email for your records and for any tax or reimbursement purposes.
4.6 All lesson packages and courses must in principle be paid in full in advance by bank transfer (unless another method is offered and agreed). A booking is only confirmed once the full payment has been received by us within the specified payment term. If payment is not received on time, we may cancel the reservation and offer the time slots or course places to other learners.
5. Cancellations and rescheduling
5.1 Private lessons (online)
- For private lessons, you may cancel or request to reschedule a lesson free of charge up to 24 hours before the scheduled start time of the lesson.
- If you cancel or request to reschedule with less than 24 hours’ notice, or if you do not attend the lesson, the lesson will be considered as taken and the full lesson fee remains payable.
- Repeated last-minute cancellations or rescheduling requests may result in us refusing further rescheduling and/or asking you to book a new package.
5.2 Group lessons (online and in-person)
- For group courses, your registration applies to the full course (all sessions), not to individual lessons.
- You may cancel your participation in a group course up to 7 calendar days before the course start date. In that case, the course fee already paid will be refunded in full.
- If you cancel less than 7 calendar days before the course start date, or after the course has started, the full course fee remains payable subject to your statutory right of withdrawal as described in clause 3.
- If you withdraw from a group course under the 14-day cooling-off right after the course has started, you will pay only for the lessons that have already taken place, and we will refund the course fees for the remaining lessons that have not yet taken place.
- Absence from one or more group lessons does not in itself entitle you to a refund or a replacement lesson, unless the teacher decides otherwise at their sole discretion. However, upon request, a catch-up private lesson may be offered at the teacher’s discretion, subject to an additional fee for the difference between group and private rates.
5.3 Cancellations by the teacher
- In the unlikely event that we have to cancel a lesson or a full course (for example due to illness or other circumstances beyond our control), we will inform you as soon as reasonably possible and offer a new date or an alternative teacher, where available.
- If rescheduling or an alternative teacher is not reasonably possible, we will refund the fees for the affected lesson(s) or the remaining part of the course.
5.4 Delays and technical problems
- If you arrive late for a private lesson, the lesson will still end at the agreed time and the full lesson fee remains payable.
- If a lesson cannot take place or has to be interrupted due to technical problems on your side (internet connection, device, software), this will be treated as a late cancellation or a missed lesson.
- If a lesson cannot take place due to technical problems on our side, we will offer a new date for the remaining time of the lesson or, if rescheduling is not reasonably possible, we will refund the relevant part of the lesson fee.
5.5 Exceptional circumstances
We understand that emergencies can happen. In exceptional cases (for example serious illness or other unforeseen emergencies), we may, at our sole discretion, deviate from the above rules and offer a partial refund, credit or rescheduling. Any such exception is voluntary and does not create a right for similar treatment in future situations.
6. Behaviour, Code of Conduct and Exclusion
6.1 You are expected to behave respectfully towards the teacher and, where applicable, other learners. Any form of harassment, discriminatory language, threatening behaviour or other unacceptable conduct is strictly prohibited.
6.2 You may not disrupt lessons, use inappropriate or offensive language, or behave in a way that makes it difficult or impossible to conduct the lesson properly.
6.3 In case of a violation of this code of conduct, we may first issue a warning. If the behaviour continues or in case of serious misconduct, we have the right to terminate the contract, exclude you from (further) participation, and refuse future bookings. In such cases, you are not entitled to any refund for lessons or courses already paid.
7. Recording Lessons and Teaching Materials
7.1 We do not record lessons for later viewing, unless explicitly agreed otherwise with you.
7.2 You are not allowed to record audio, video or screenshots of any lesson without our explicit prior written consent (for example by email). If consent is granted, the recording may only be used for your personal study purposes and may not be shared with third parties.
7.3 All self-made materials provided by us (including but not limited to PDFs, slides, exercises, vocabulary lists and other handouts) are protected by copyright and remain our intellectual property. You receive a non-transferable, non-exclusive right to use these materials for your personal study purposes only.
7.4 It is strictly prohibited to copy, distribute, publish, upload, share on social media, or otherwise make the materials available to third parties, including by screenshots or similar methods, without our prior written consent.
7.5 Materials from third-party publishers or other rights holders that are used or recommended during the lessons remain the property of their respective owners and are subject to their own licence terms.
8. Liability
8.1 Learndutch.eu is not liable for any indirect or consequential damages, such as loss of income, time, or expected results, arising from the use of our lessons or materials.
8.2 Any direct liability of Learndutch.eu is limited to the amount of the lesson or course fees paid by you for the part of the service to which the liability relates.
8.3 You are responsible for having a suitable internet connection, device and software for online lessons. Learndutch.eu is not liable for technical problems on your side. If a lesson cannot take place due to technical problems on our side, a new date will be offered.
9. Personal data (Privacy)
9.1 We process your personal data in accordance with our Privacy Policy, which is available on our website.
9.2 By booking a lesson or course, you acknowledge that you have read the Privacy Policy and agree to the processing of your personal data for the purposes described there (such as lesson communication, invoicing and legal accounting obligations).
9.3 We may keep records of lessons and homework (for example notes, assignments and chat logs) for the same retention period as stated in our Privacy Policy. These records are used to improve your progress and the quality of our teaching.
9.4 We may use anonymised information and examples derived from lessons (for example typical learning challenges or anonymised sentences) for marketing, educational or research purposes, such as blog posts, presentations or course improvements. In such cases, no information will be published that allows individual learners to be identified.
10. Governing law and disputes
10.1 These Terms and Conditions and any agreements between you and Learndutch.eu are governed by Dutch law.
10.2 If you have a complaint, please contact us first so that we can try to resolve the issue together.
10.3 If a dispute cannot be resolved amicably, it will be submitted to the competent court in the Netherlands.
11. Language versions
11.1 These Terms and Conditions are drawn up in English and may be accompanied by an informal Japanese summary for convenience.
11.2 In case of any discrepancy or inconsistency between the English version and the Japanese summary, the English version shall prevail.
